Jefferson City, MO – A losing candidate in Missouri's Democratic primary for attorney general has filed suit alleging some ballots were wrongly uncounted.
Margaret Donnelly lost by 780 votes to Chris Koster. More than 346,000 votes were cast August 5.
Last week Donnelly asked Secretary of State Robin Carnahan for a recount.
Donnelly's lawsuit says she was told by Carnahan's office that the re-count would omit absentee and provisional ballots that local election authorities decided should not be counted.
Donnelly claims some of those ballots were wrongly rejected. Her lawsuit names election officials in 26 counties.
It asks the state Supreme Court to order the contested ballots to be reviewed and re-counted.
