Springfield, Ill. – The state of Illinois is asking for a restraining order in its battle to keep an Air National Guard unit from being moved to Indiana.
A hearing on the request is scheduled for tomorrow morning in U.S. District Court Springfield.
The Pentagon has recommended moving Springfield's 183rd Fighter Wing to Fort Wayne, Indiana as part of the base closure and realignment.
The plan has been approved by a federal commission and now goes to the president and Congress.
Illinois officials want a judge to bar the commission from sending that recommendation to the president.
They argue that National Guard units are under the governor's command and can't be moved without his permission.
Governor Rod Blagojevich says that would reduce protection for Illinois in case of a terrorist attack.
