Jefferson City, MO – A judge on Monday ruled that the Missouri Attorney General's may sue the Department of Natural Resources over an old railroad bridge.
Attorney General Jay Nixon sued the department in May. He claims DNR had no legal authority to relinquish the state's right use the bridge, which is part of the Katy Trail State Park.
The department responded by challenging Nixon's legal authority to sue. The department claimed Nixon's office should be disqualified from the case because one of its attorneys previously advised the department on matters involving the bridge.
But Cole County Judge Byron Kinder on Monday rejected the request to disqualify Nixon's office.
