Father Sues Springfield Hospital Over Foster Death

By AP/KWMU

Springfield, Mo. – The father of a Missouri boy who died in foster care is suing a Springfield hospital system. He says the facility failed to give the boy adequate medical care.

The death of Dominic James in 2002 sparked a wide-ranging review of the state's foster care program.

Sidney James' suit alleges negligence and wrongful death against CoxHealth. Three hospital workers and Emergency Physicians of Springfield also are named as defendants.

The suit alleges the defendants failed to notice signs of possible child abuse when Dominic was first hospitalized two years ago.

James claims if medical personnel had reported bruising, Dominic may not have been returned to the Willard foster home of John Dilley.

Dilley has been convicted of shaking Dominic to death.
