Missouri Supreme Court Upholds Concealed Gun Law

Jefferson City, MO – The Missouri Supreme Court has upheld the constitutional right of lawmakers to authorize concealed guns. But the court also said the new concealed guns law doesn't have to be enforced in four counties, where it would be an unfunded mandate.

The ruling opens the way for similar unfunded mandate claims in other counties. And that raises the possibility of a piece-meal enforcement of the law.

Attorney General Jay Nixon says sheriffs can legally begin issuing concealed gun permits. However, Nixon suggests that they wait until the Legislature revises the unfunded mandate issue.

House Republican Larry Crawford, of California, looked for the decision -- and filed legislation yesterday that could be used to patch up the law.

Supporters and opponents of concealed gun rights both claim victory.

The law allows people age 23 and older to receive concealed gun permits from their local sheriffs. First they'll have to pass criminal background checks, take firearms training courses and pay a fee of up to 100 dollars.
