St. Louis, MO – The American Civil Liberties Union will file a motion this week to dismiss charges against six men who were caught having sex.
The men were charged under a rarely used Missouri statute that bans sex between people of the same sex. The men were caught having sex during a March raid of an adult video store in High Ridge, 20
miles south of St. Louis.
A woman who also was caught having sex at the store was freed, because her conduct is not illegal under Missouri law.
Denise Lieberman of the American Civil Liberties Union of Eastern Missouri says the case illustrates the inequity of Missouri's sexual misconduct statute.
Missouri is one of only four states --Kansas, Oklahoma and Texas are the others -- where homosexual sex is illegal. Nine other states ban sodomy for everyone.
