Edwardsville Pharmacists Sue Blagojevich Over Birth Control Order

Springfield, Ill – A spokeswoman for Governor Rod Blagojevich says the governor's office will fight a lawsuit by two pharmacists who don't want to fill contraception prescriptions.

Abby Ottenhoff says the lawsuit filed Wednesday in Springfield is an attempt to block women from having access to health care.

The American Center for Law and Justice filed the suit on behalf of Peggy Pace and John Menges, registered pharmacists from Edwardsville.

It seeks preliminary and permanent injunctions against Blagojevich's emergency rule, filed April first.

The rule requires pharmacies to fill birth control prescriptions without delay.

If the contraceptive is not in stock, the pharmacy must order it or transfer the prescription to a nearby pharmacy.
