Jefferson City, Mo. – A St. Louis County judge cannot preside over the retrial of a man charged in a 1992 courthouse shooting spree.
Tuesday's state Supreme Court ruling means that a new judge will have to be appointed from St. Charles County.
St. Louis County Circuit Judge Mark Seigel had kept himself on the case of Kenneth Baumruk after transferring it to St. Charles County.
But the Supreme Court ruled a judge cannot follow a case to another circuit, without special approval from the Supreme Court, and Seigel had not sought that.
Baumruk was convicted of killing his wife and injuring four others during the shooting rampage. But the Supreme Court previously ordered a new trial because the original one was held in the same courthouse where the shootings occurred.
