Jefferson City, Mo. – Governor-elect Jay Nixon is not using the state's new e-mail archiving system.

It's meant to simplify looking up responses to public records requests.

As governor-elect, Nixon normally would have begun using the e-mail servers maintained by the Office of Administration.

Instead, records show Nixon's transition team chose to use the attorney general's archiving system.

Nixon spokesman Oren Shur says many transition team staffers came from the attorney general's office, and they need a familiar system.

Under normal circumstances this might not be an issue. But Nixon is still attorney general, and his special investigators are suing Governor Matt Blunt to determine whether the governor's e-mail practices are legal.

Of specific concern is whether Blunt's staff deleted some messages last year that should have been preserved under Missouri's document-retention and open-records laws.
