Appeals court dismisses Katy bridge case

Jefferson City, MO. – An appeals court has upheld the dismissal of a lawsuit by environmentalists trying to save an old Katy Railroad bridge at Boonville.

Today's decision by the Western District state Court of Appeals affirms a ruling from one year ago by a Cole County judge.

At issue is whether the state can relinquish its interest in the old Missouri River bridge to allow Union Pacific to dismantle it and use the steel elsewhere.

Both Attorney General Jay Nixon and the Great Rivers Environmental Law Center challenged the move. A Cole County judge ruled against Nixon last year and then dismissed a similar lawsuit by the environmental center.

The Western District has not ruled yet on Nixon's appeal.
