St. Louis – Missouri Citizens for Property Rights filed suit last month to challenge a Secretary of State ruling that the group had not collected enough valid signatures.
Missouri law requires supporters of ballot proposals to gather a certain number of signatures from each Congressional district. It fell short in one near St. Louis.
The group's leader now says it's obvious there is no way the group will be able to get enough names.
The measure would have restricted the use of eminent domain by non-government bodies and for private use. Supporters say they'll try again in 2010.
