Hancock family drops wrongful death lawsuit

St. Louis – The family of Josh Hancock has dropped a wrongful death lawsuit against Mike Shannon's restaurant and others whom they had blamed for the drunk driving death of the late Cardinals pitcher.

The defendants included Jacob Hargrove, the operator of the tow truck that Hancock hit on Highway 40, and Justin Tolar, the driver of the disabled vehicle that Hargrove had stopped to help at the time of the accident.

The Hancock family's local attorney, Mark Bronson, filed the motion to "dismiss without prejudice" Monday morning, just prior to a hearing before a judge in St. Louis Circuit Court on the merits of the case.

The lawsuit alleged that others shared responsibility for Josh Hancock's death.

Police say Hancock was drunk, speeding and using a cell phone at the time of the accident.
