St. Louis – The driver involved in the crash that killed Cardinals pitcher Josh Hancock plans to file a countersuit against the player's estate, unless the Hancock family drops its wrongful death suit against him.
Hancock's family claims that Jacob Hargrove negligently parked his tow truck in the left lane of Interstate 64 while helping a stranded driver.
Hargrove's attorney Robert Pedroli says he's not looking to punish the family, but he calls their lawsuit frivolous.
Hancock was killed April 29 after his SUV hit the back of Hargrove's truck.
Police say Hancock was drunk, speeding and talking on his cell phone when he crashed.
