MLB appeals fantasy baseball ruling

St. Louis – Attorneys representing Major League Baseball say that online fantasy baseball companies can't operate without paying license fees to the league.

The attorneys made their arguments Thursday before a three-judge federal appeals panel in St. Louis.

Baseball is appealing a lower court judgment last year that ruled Louis-based CBC Distribution and Marketing does not have to pay licensing fees to use players' names and statistics as fodder for online fantasy league games.

MLB says the company is exploiting the players' names to make money.

An attorney representing CBC says the company simply uses public statistics to help players form their fantasy league rosters.

The judges adjourned Thursday's hearing and said they will rule at a later time.
