Edwardsville, Ill. – A grand jury in Madison County has decided against accusing a Granite City man in the death of a highway worker in April.
Garrett Stearns, 27, does face traffic charges, including speeding, but he won't be charged with reckless homicide in the accident that killed Henry Heath of Godfrey.
Authorities say a trailer Stearns was pulling jack-knifed and hit Heath. Prosecutors say there's no evidence Stearns was driving drunk, and they say an state vehicle was parked improperly nearby and might have contributed to Heath's death.
Stearns also faces charges of failure to yield in a construction zone, registration violation and driving with inoperative brakes and lamps.
