Springfield, Ill. – A federal judge has dismissed a state lawsuit aimed at stopping the military from moving fighter jets from Illinois to Indiana.
Judge Jeanne Scott says the plan to move the Air National Guard unit is not final, so the state has suffered no harm and cannot sue yet.
She dismissed the state's request for a temporary restraining order, along with its entire lawsuit.
Illinois officials argue it's illegal for the federal government to move the 15 F-16 fighter jets without the approval of Governor Rod Blagojevich, since the National Guard is under his command.
