Judge tosses out Missouri BRAC suit

Washington – A federal judge throws out Missouri's lawsuit to stop the federal base closing commission from shuttering an Air National Guard unit in St. Louis.

The Missouri attorney general's office said the state would file an immediate appeal to the Eighth U.S. Circuit Court of Appeals.

Governor Matt Blunt asked attorney general Jay Nixon to file the lawsuit on August 26th. Hours earlier the base closure panel voted to shut down the 131st Fighter Wing based at Lambert Airport in St. Louis and move its fighter jets to bases in Nevada and Montana.

The state argued that the Pentagon is required to consult with state governors before closing the bases.
